Few Contract Complaints

The company does not list details about its pricing or terms on its website, and there are very few merchant complaints that specifically describe the company’s terms and fees. One merchant claims that they were promised $30 per month in fixed fees by their sales agent, but were charged $162 for their first month of processing. In addition, the merchant states that they were hit with a $1,800 early termination fee once they canceled, although this fee appears to be linked to a long-term equipment lease. 2 other merchant reviews describe non-cancellable long-term equipment leases of five years. A company representative from Empyrean Merchant Services conveys that the company’s equipment leases last 24 months or longer which begin at $15 per month. According to the same company representative, Empyrean Merchant Services does not even charge an early termination fee.
Long-Term Equipment Leases
Although an $1,800 cancellation fee may seem extravagant, it’s actually on the low side for a four-year equipment lease. Merchants are encouraged to purchase rather than lease equipment whenever possible, as most credit card terminals can be bought for $500 or less. As noted above, both complaints are related to sales issues such as undisclosed fees and misrepresented contract terms from a sales representative. Even so, the company’s complaint total is lower than expected for a company that is possibly eight years old.

In this case, we are able to locate a handful of Empyrean Merchant Services complaints that describe nondisclosure of fees, misrepresentation of the seller’s identity, and aggressive sales tactics. 2 of these complaints (found in the comment section below) specifically mention an employee of Empyrean Merchant Services, Mike Haley, as the agent who misrepresented the merchants’ monthly cost.
